Property Distribution:

In the event of a divorce, your first big question is often, simply, "what am I entitled to?"  This is not a selfish inquiry -- it is, instead, essential information you need to determine how you will survive going forward, how your current and future needs (and those of your children) will be met when your life is entering a period of major transition.

Will assets now shared between you and your spouse be divided 50-50? Are you or your spouse entitled to more than 50% of the assets? How will we divide up the assets? What does the law say? What is fair? Who pays the debts? What about the mortgage? What if you both want the house, who gets it? Where do the children live? What if your name is on your spouse’s car? What if all the debt is in your name? Are you responsible for it all? What if the house is not in your name? Does that mean you don’t get to share in the equity? What if your spouse is self-employed? How much is his or her business worth? Do you have to share your business with your spouse? What about distribution of retirement benefits? Can you trade one asset for another? Can you keep your retirement and give your spouse the house as a fair trade? In today’s economy, how do you know what the house or the business is worth? What about your investment accounts? How do you divide those without having to pay taxes or penalties? Do you have to give your spouse a part of your pension now? Or will he or she have to wait until you retire?
